Terms of Service

Welcome to Hi Stakes Markets Game ("Hi Stakes Markets Game", "the Game", "the Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Excerion Sun LLC ("we", "us", "our").

By downloading, installing, accessing, or playing Hi Stakes Markets Game, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Nature of the Service (Fictional Simulation)

PLEASE READ CAREFULLY:

Hi Stakes Markets Game is a fictional financial simulation Massively Multiplayer Online (MMO) game.

  1. Simulation Only: All assets, stocks, derivatives, currencies ("Credits"), and market data represented in the Game are entirely fictional. They are generated by a computer simulation for entertainment purposes only.
  2. No Real Value: Virtual items and currency in the Game have no real-world monetary value. They cannot be exchanged for legal tender, crypto-currency, or real-world goods, and cannot be transferred outside of the Service.
  3. Not Financial Advice: The market movements, volatility models, and analyst reports provided within the Game are procedurally generated game mechanics. Success within Hi Stakes Markets Game does not guarantee, imply, or correlate with success in real-world financial trading or investing.
  4. Brokerage as Counterparty: All trading actions (buying, selling, derivatives) are executed against the Game's internal simulated brokerages. There is no peer-to-peer exchange of real value.

2. Eligibility

You must be at least 13 years of age to access the Service. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that your legal guardian has reviewed and agreed to these Terms.

2.1. Minors

If we learn that an account was created by a child under the permitted age without parental consent, we will delete the account in accordance with our Privacy Policy and applicable law.

3. Accounts

To access certain features, you may be required to create an account.

  • One Account Policy: You agree to create and use only one (1) account. Creating multiple accounts ("Multi-accounting") to gain an unfair advantage, accumulate resources, or circumvent game mechanics is strictly prohibited and will result in the termination of all associated accounts.
  • Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • No Transfers: You may not sell, transfer, gift, or assign your account, username, or Virtual Currency/Items to any third party. Any attempt to do so is a violation of these Terms and may result in immediate termination.
  • Deletion: You may delete your account at any time via the in-app settings. Warning: Deleting your account is permanent. You will immediately lose access to all progress, Virtual Currency, and Virtual Items associated with the account.

3.1. Data Rights vs. Asset Forfeiture

Deleting your account forfeits all in-game assets (Credits, Items). However, requests to delete personal data will be processed separately in accordance with our Privacy Policy and applicable law.

4. Virtual Goods and Currency

The Service includes virtual currency (e.g., "Credits") and virtual items (e.g., "Stocks", "Options").

  • License: Virtual Currency and Items are licensed, not sold, to you. You have a limited, non-exclusive, non-transferable, revocable license to use them solely within the Game.
  • No Expiration: Virtual Currency and Items do not expire as long as your account remains active. However, if you delete your account, or if your account is terminated for a violation of these Terms, all Virtual Currency and Items are forfeited.
  • Game Balancing: We reserve the right to modify, manage, regulate, control, or remove Virtual Currency and Virtual Items at our sole discretion for the purpose of game balancing, economy management, or fixing exploits. We shall have no liability to you or any third party for the exercise of such rights.
  • No Ownership: You acknowledge that you do not own the Virtual Currency or Items. Excerion Sun LLC retains all right, title, and interest in the Game code, data, and assets.

5. Purchases and Refunds

Hi Stakes Markets Game is free to play. The Service offers optional In-App Purchases (IAP).

5.1. Platform Processing

All payments are processed by the third-party platform from which you downloaded the Game (e.g., Apple App Store, Google Play Store). Excerion Sun LLC does not collect or store your full credit card information.

5.2. Refund Policy

All sales are final. Excerion Sun LLC does not offer refunds for Virtual Currency or other digital goods, except as required by applicable law.

  • iOS: Refunds are handled exclusively by Apple in accordance with their policies.
  • Android: Refunds are governed by Google Play policies.
  • We reserve the right to terminate the account of any user who attempts to abuse the refund policies of the platforms (e.g., "chargeback fraud").

6. User Conduct

You agree to play fairly and respect the integrity of the simulation. You agree NOT to:

  1. Automate: Use bots, macros, scripts, auto-clickers, or third-party software to automate gameplay, trade execution, or AMOE requests.
  2. Exploit: Intentionally use bugs, glitches, or vulnerabilities in the Game logic or server to gain an advantage.
  3. Reverse Engineer: Attempt to decompile, reverse engineer, or access the source code or backend APIs of the Game.
  4. Interfere: Attempt to disrupt the servers or overload the infrastructure.
  5. Harass: Harass, threaten, or defraud other users or Excerion Sun LLC staff.

6.1. Enforcement & Appeal

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these rules. If your account is suspended or terminated, you may request a review by contacting support@excsn.com within 14 days of the notice. We will use commercially reasonable efforts to respond within 30 days.

7. Intellectual Property

All content within Hi Stakes Markets Game, including but not limited to the simulation engine, narrative text, "chatter," news reports, artwork, and code, is the proprietary property of Excerion Sun LLC. You are granted a limited license to access this content for personal, non-commercial entertainment use only.

8. Sweepstakes

From time to time, we may conduct sweepstakes or giveaways ("Promotions").

  • Official Rules: Each Promotion is governed by separate Giveaway Rules.
  • No Purchase Necessary: Promotions are subject to "No Purchase Necessary" laws. You may request a free entry code via the AMOE Portal on our website.
  • Taxes: You are solely responsible for any taxes, withholdings, or reporting obligations related to prizes awarded through the Service.

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE."

EXCERION SUN LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SIMULATION WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT THE MARKET DATA WILL BE CONTINUOUSLY AVAILABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCERION SUN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL EXCERION SUN LLC'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID EXCERION SUN LLC IN THE 12 MONTHS PRECEDING THE DATE OF THE ACTIVITY GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Excerion Sun LLC and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Dispute Resolution (Binding Arbitration)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

12.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12.2. Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be determined by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, or another location mutually agreed upon.

12.3. Arbitration Costs

For consumer claims where you are the claimant, Excerion Sun LLC will pay AAA filing, administration, and arbitrator fees that exceed $200 USD, to the extent permitted by AAA rules, so as not to prevent an individual from pursuing a claim.

12.4. Injunctive Relief

Notwithstanding the arbitration agreement, either party may seek provisional or injunctive relief in any court of competent jurisdiction to prevent irreparable harm (including to protect intellectual property or stop fraud/botting).

12.5. Class Action Waiver

YOU AND EXCERION SUN LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or website at least 30 days prior to the effective date of the changes. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
